随着香港和澳门的回归,我国区际冲突的问题日益凸现,其中公共秩序保留制度在我国区际私法中的适用,一直是学者们普遍关注的问题。本文将对公共秩序保留制度在区际冲突中运用的理论进行探讨,在比较典型的多法域国家立法及司法实践的基础上,结合我国各法域现行立法的现状,对公共秩序保留制度在我国区际法律冲突的具体运用提出指导性的建议。

With the regress of Hong Kong and Macao,the problem of area conflict is becoming obvious.The application of public order reservation system in China private area laws is one of the main concerning of scholars.This paper will probe into the theory of the application of public order reservation system in area conflict.With the reference of actuality of our national lawmaking, we provide instructional advice to the actual use of the public order reservation system in China area conflict,which on the basis of lawmaking and judicature of the multi-law dimensional countries.
