美国南北经济基础的差异决定了内战不可避免是学界主流的观点。长久以来,从美国宪制运作的角度来分析内战的发生被人忽视,事实上,制度性原因的探寻亦具相当意义。19世纪上半期,美国政治体制上出现了诸如权力配置方面的挑战,同时奴隶制议题处于美国宪政转型的中心,而立法、司法和行政各个分支在19世纪上半期的表现都应对内战的爆发有一定检讨之处。
Abstract：Seemingly the difference between the modes of production of the South and North could decide that the American Civil War would be inevitable.However analysis on the antebellum constitutional operation,which should be very meaningful,has long been ignored.In the first half of the 19th century many challenges had been shaking the American constitutionalism structure,in which slavery issue was in the Centre on the Constitutional transformation.But the issue alone could not be the only and inevitable cause of the Civil War.All the branches of the government,Legislative,Judicial and Administrative,should be to blame for that War.
